154 the atmosphere will convey, but this is not a material consideration at the present moment. It is enough for present purposes that no one has produced currents that were capable of being conveyed by conduction through any portion of the atmosphere that had been reached, or, if capable of being so conducted, no one knew of the fact. We do not think it necessary to go into a discussion of what might take place in Mr. Edison's system after what has been shown. Mr. Edison is certainly a very high authority in electrical matters, and it is hardly reasonable that the office should question his statements in the absence of any evidence that they are wrong. He shows and describes an ap peratus specially designed to work by induction, and declares that it works on this principle. If it does it cannot by any possibility work by conduction, as the conditions essential to the one are fatal to the other. We think that Mr. Tesla has sufficiently explained the distinction between his method and that of Hertz. We, of course, are desirous of presenting the case in a manner that will conform to the examiner's views as far as we find it possible to do so, but we think that the points at present unsettled between the office and ourselves, as indicated by the Examiner's last letter, should first be cleared up. We ask that the matter be reconsidered in connection. with the two communications which we now file. -3Kene Curtis Wage alty for Tesla.
